Conditions d’utilisation

Version tos-2026-10-08, effective October 8, 2026.

These Terms are published in English. The English version is the binding version.

PLEASE READ CAREFULLY. Section 19 contains an agreement to resolve disputes by binding individual arbitration and a waiver of class actions and jury trials, with a small-claims exception and a 30-day right to opt out. Our services are simulated trading evaluations: no real money is traded, and free content, demonstration and test accounts never pay out (Section 7).

1. Who we are and how these Terms work

Funded With Forex and Funded With Perps are brands operated by Funded With Forex LLC, a Wyoming limited liability company, 30 N Gould St, Ste N, Sheridan, WY 82801, USA ("Funded With Forex", "we", "us"). All payments, payouts, refunds and obligations under these Terms run to and from Funded With Forex LLC. Bank transfers from us may show the sender name "Funded With Forex LLC" or that of an affiliated company.

These Terms of Service ("Terms") govern your use of our websites, dashboards, evaluations, funded accounts, subscriptions and related services, including the trading platform provided to us by our sister company Vera Charts LLC (together, the "Services"). Our Privacy Policy, Refund Policy and Risk Disclosure, and any agreement you sign with us (the Funded Trader Agreement or the Affiliate Agreement), form part of your agreement with us.

You accept these Terms by ticking the box that says you agree to them when you create an account, sign in for the first time after they change, or make a purchase. If you do not agree, do not use the Services. You agree that ticking that box is your electronic signature, that we may deliver these Terms, notices and records to you electronically, and that we keep a record of your acceptance (the version, time, IP address and device).

We may translate these Terms. If a translation differs from the English version, the English version controls.

2. Eligibility

You must be at least 18 years old and the age of majority where you live, able to enter a binding contract, and not located in, or a resident or national of, a country or region where we do not offer the Services or that is subject to comprehensive sanctions. You must not be on any sanctions or restricted-party list.

Each account belongs to one natural person. You must give accurate, current and complete information and keep it updated. We may ask you to verify your identity, address and age at any time, and identity verification is required before any payout.

3. Simulated trading only; no investment advice

The Services are a simulated trading education and skill-assessment product. No real customer funds are deployed to any market through your evaluation or funded account. Orders are filled in a simulated environment using live or delayed market data, and simulated fills, spreads, slippage and prices may differ from what would happen in a real market. Account balances, equity and profit and loss are simulated figures, not money you own or can withdraw, except for a performance reward that we approve and pay under Section 6.

We are not a broker, dealer, futures commission merchant, investment adviser, commodity trading advisor or commodity pool operator, and we do not hold, manage or invest your money. Nothing in the Services, including any content, education, indicator, signal, statistic or communication from us, our staff or our partners, is investment, financial, legal or tax advice, or a recommendation to buy or sell anything. We owe you no fiduciary duty.

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.

Most evaluations are not passed. Read the Risk Disclosure before you buy.

4. Evaluations

An evaluation is a paid, simulated skill assessment. Each one has a published profit target, daily loss limit, maximum loss limit, minimum trading days and any consistency or other rule, shown on the pricing page at the time of purchase. Breaching any rule ends the evaluation. The rules shown when you buy are recorded with your account and govern it for its lifetime; they are not changed retroactively.

The fee buys access to the evaluation, not a deposit, investment or balance. Evaluations, resets and accounts are personal and cannot be transferred, sold or shared.

5. Funded accounts

If you pass an evaluation, you may be offered a simulated funded account after you sign the Funded Trader Agreement and complete identity verification. A funded account is still simulated. The Funded Trader Agreement governs funded accounts, performance rewards and payouts; if it conflicts with these Terms on those subjects, it controls, except that Section 19 of these Terms always governs disputes.

6. Performance rewards and payouts

On an eligible funded account, you may request a performance reward of up to 90% of simulated profit, subject to the minimum trading days, payout caps and other conditions in the Funded Trader Agreement and on our website. A performance reward is a fee we pay you, from our own funds, for your trading performance in a simulated environment; it is not a share of real trading profits and not a return on any investment.

You receive performance rewards as an independent contractor, not as an employee, partner or agent. You are responsible for your own taxes and must provide the tax forms we request. We may review any payout request for up to 30 calendar days if the trading record suggests a rule violation, coordinated trading, exploitation of pricing or feed errors, or any prohibited conduct. If a review finds a violation, the account is closed and no reward is paid; if not, the reward is released in the normal way.

7. Free content, demonstration and test accounts never pay out

We sometimes give accounts at no charge to creators, affiliates, partners, reviewers, our team and testers so they can film, review, demonstrate or test the Services ("Content Accounts"). We tell the holder when an account is a Content Account.

A Content Account is for demonstration only. It is never eligible for payouts: it cannot be withdrawn from, and it earns no performance reward, profit split, payout, commission or other money. Its balance, equity, profit and loss have no cash value, whatever the account shows and whether or not it meets any evaluation or funded-account rules.

A Content Account holder must not say or imply, in any content or communication, that a Content Account pays out, has paid out or can be withdrawn from, and must not present its results as a paying customer's results without saying it is a free content account.

No statement by any employee, contractor, partner manager, support agent or automated assistant, in any email, chat or call, can make a Content Account eligible for payouts or otherwise change these Terms. Only a written amendment signed by an authorized officer of Funded With Forex LLC can.

We may reset, change or close a Content Account at any time. A prize account won in a giveaway is not a Content Account unless the giveaway's Official Rules say so; it follows those Official Rules.

8. Prohibited conduct

The following void your evaluation or funded account without refund: latency arbitrage; exploiting pricing or data errors; copy trading between our accounts and external accounts, or between accounts of different people; automated trading bots unless we approve them in writing; using AI assistants to place trades; account sharing or trading on another person's account; holding opposite positions across accounts to hedge; operating multiple identities; and any behavior reasonably construed as gaming the evaluation to extract rewards rather than demonstrating trading skill.

Automated or programmatic access is prohibited, including browser-automation tools (such as Playwright, Puppeteer or Selenium), headless browsers, scripts or software that submit orders or interact with the Services or our APIs outside the normal human interface, scraping, and automated account creation or entry submission. We use technical detection. Where we detect it, we may record and flag the account, IP addresses and device identifiers, withhold or permanently deny any pending or future payout, and suspend or close the account and related accounts, at any time and at our discretion.

You must not use the Services for any unlawful purpose, to infringe anyone's rights, to upload malicious code, to interfere with the Services or their security, or to reverse engineer them except where the law allows it.

9. Purchases, refunds and chargebacks

Prices are charged in US dollars; any other currency shown is an estimate. The price at checkout includes any discount applied. You authorize us and our payment processors to charge your payment method for each purchase. Refunds are governed by the Refund Policy, which is part of these Terms.

If you have a problem with a charge, contact support first. A chargeback or payment reversal on a purchase you made or authorized is a breach of these Terms: we may suspend or close the related accounts, withhold any pending reward or commission, and give your payment provider the records of your purchase, acceptance of these Terms, logins and use of the Services.

Promotional and discount codes have no cash value, cannot be combined unless we say so, and may be withdrawn at any time.

10. Subscriptions and automatic renewal

Some add-ons (for example Copy Helper) are subscriptions. Before you subscribe we show the price and billing period. A subscription renews automatically at the end of each billing period and your payment method is charged the price shown until you cancel. You can cancel at any time online from your dashboard; cancellation takes effect at the end of the current billing period, and you keep access until then. We do not give partial refunds for unused time unless the law requires it. If we change a subscription price, we will tell you before it applies, and you can cancel before the new price is charged.

11. Affiliates, creators and partners

Our affiliate and creator program is governed by the Affiliate Agreement, which each partner must sign. Partners are independent contractors, not our employees, agents or representatives, and cannot make promises or statements on our behalf.

Partners must clearly disclose their relationship with us (for example #ad or "paid partnership") in every promotion, as required by the U.S. Federal Trade Commission and similar laws elsewhere, and must not make income, earnings, pass-rate or payout claims, promise payouts, or present a Content Account as one that pays out (Section 7).

12. Your account and communications

Keep your login secure and tell us at once about any unauthorized use. You are responsible for activity on your account. We may send you service, security, transactional and legal messages by email or in the dashboard. Marketing messages are optional and you can unsubscribe at any time.

13. Intellectual property and feedback

The Services, including software, charts, designs, text, logos and trademarks, belong to us or our licensors. We give you a limited, personal, revocable, non-transferable license to use the Services for their intended purpose under these Terms. If you send us suggestions or feedback, we may use them without any obligation to you.

14. Third-party services

The Services rely on third parties, including the trading platform operated by Vera Charts LLC, market data providers, payment processors and an identity verification provider. We are not responsible for third-party services we do not control, and their own terms may also apply.

15. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend or close any account, or refuse service, if we reasonably believe you breached these Terms or any agreement with us, if required by law, or to protect the Services, other users or us. Sections that by their nature should survive (including Sections 3, 7, 9, 13 and 16 to 22) survive termination.

16. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT MARKET DATA, PRICES, FILLS OR CALCULATIONS ARE ACCURATE, COMPLETE OR TIMELY, OR THAT THE SERVICES WILL BE AVAILABLE AT ANY PARTICULAR TIME.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER WE NOR OUR SISTER COMPANIES, NOR OUR OR THEIR MEMBERS, MANAGERS, OFFICERS, EMPLOYEES OR AGENTS, ARE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS (INCLUDING SIMULATED OR ANTICIPATED PROFITS OR REWARDS), LOST DATA OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, INCLUDING LOSSES CAUSED BY MARKET DATA OUTAGES, PLATFORM DOWNTIME OR THIRD-PARTY FAILURES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) US$100.

These limits do not apply to liability that cannot be limited or excluded by law.

18. Indemnification

To the extent permitted by law, you will defend, indemnify and hold harmless us and our Sister Companies, and our and their members, managers, officers, employees and agents, from any third-party claim, loss, liability and reasonable legal fees arising out of your breach of these Terms or any agreement with us, your violation of law or of anyone's rights, or content you publish about the Services.

19. Dispute resolution: individual arbitration, class action and jury trial waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS. You can opt out within 30 days (see Right to Opt Out below) by emailing [email protected].

19.1 Informal Resolution First. Before either of us starts an arbitration or a small-claims case, the party with the dispute must send the other a written Notice of Dispute, and both of us must try in good faith to resolve it for 60 days. Send yours to [email protected] with the subject "Notice of Dispute"; we send ours to the email address on your account. A Notice must include the sender's name, the email address on the account, a description of the dispute and the relief requested, and a Notice from you must be personally signed by you, not only by a lawyer or agent. If either of us asks, we will each take part in an individual phone or video call about the dispute during that period. Any limitation period is paused from the day a complete Notice is sent until the 60 days end. This step does not apply to a request for urgent injunctive relief described under Exceptions.

19.2 Agreement to Arbitrate. Except as stated under Small Claims and Exceptions, you and Funded With Forex agree that any dispute, claim or controversy between us arising out of or relating to the Terms of Service, the Funded Trader Agreement, the Affiliate Agreement, the Services, any evaluation, funded, content or other account, any purchase, reset, subscription, refund, chargeback, payout, reward or commission, or our marketing or communications, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, and whether it arose before or after you accepted this agreement to arbitrate, will be resolved by final and binding arbitration on an individual basis and not in court. This agreement to arbitrate also covers claims against, and may be enforced by, our Sister Companies (including Vera Charts LLC) and our and their members, managers, officers, employees and agents. The U.S. Federal Arbitration Act (9 U.S.C. § 1 and following) governs this agreement to arbitrate.

19.3 Who Decides. The arbitrator decides all questions about the interpretation, applicability, scope, enforceability and formation of this agreement to arbitrate, including whether a dispute must be arbitrated, except that a court decides (a) whether the Class Action Waiver is valid and enforceable, (b) any dispute about the Mass Filings procedure, and (c) whether a claim falls within Small Claims or Exceptions.

19.4 Class Action Waiver. You and we may each bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general or representative action or arbitration. The arbitrator may award relief only in favor of the individual party seeking it and only to the extent needed to resolve that party's individual claim. Administrative batching or coordination of individual arbitrations under Mass Filings is not a class or representative proceeding. If a court finds this waiver unenforceable for a particular claim or request for relief (for example, public injunctive relief), then that claim or request, and only that one, is severed, will not be arbitrated on a class or representative basis, and will be decided by a court only after all other claims have been arbitrated.

19.5 Jury Trial Waiver. If a dispute proceeds in court rather than in arbitration for any reason, you and we each waive any right to a trial by jury, to the fullest extent permitted by law.

19.6 Small Claims. Either of us may instead bring an individual claim in small-claims court in the county where you live or in Sheridan County, Wyoming, as long as the claim qualifies for, and stays in, that court on an individual basis.

19.7 Exceptions. This agreement to arbitrate does not cover (a) a request by either of us to a court for temporary or preliminary injunctive relief to stop unauthorized access to or misuse of the Services, infringement or misappropriation of intellectual property, or disclosure of confidential information, while the underlying dispute is arbitrated; or (b) a dispute that you choose to bring in court under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021.

19.8 Rules, Fees and Location. JAMS will administer the arbitration under its Streamlined Arbitration Rules and Procedures (or its Comprehensive Arbitration Rules and Procedures for a claim over US$250,000) and, where you bring the claim as a consumer, the JAMS Consumer Arbitration Minimum Standards, each as in effect when the arbitration is filed and available at jamsadr.com. If JAMS cannot or will not administer the arbitration, we will agree on another provider, or a court will appoint one under 9 U.S.C. § 5. Where you bring a claim as a consumer, you pay no more than the filing fee the JAMS consumer standards allow (currently US$250) and we pay all other JAMS administrative fees and arbitrator compensation, unless the arbitrator finds that your claim was frivolous or brought for an improper purpose under the standard of Federal Rule of Civil Procedure 11(b). Each party pays its own lawyers' fees and costs unless applicable law allows the arbitrator to award them. The arbitration will be conducted by video conference or on written submissions unless the arbitrator decides an in-person hearing is necessary, in which case it will take place in the county where you live or at another place we both agree on. The arbitrator will apply the Terms of Service, any agreement you signed with us and applicable law, may award any individual relief a court could award, and will issue a reasoned written decision. Judgment on the award may be entered in any court with jurisdiction.

19.9 Mass Filings. If 25 or more demands for arbitration raising similar claims are filed against us, or by us, by the same or coordinated counsel or organizations, you and we agree that the JAMS Mass Arbitration Procedures and Guidelines in effect at the time apply to those demands, including JAMS's ability to administer them in batches, appoint a procedural arbitrator and set fees for mass filings. Each demand must be signed by the claimant personally and include the claimant's name, the email address on the claimant's account and a description of that claimant's individual claim and the relief sought, and counsel who files it confirms that it meets the standard of Federal Rule of Civil Procedure 11(b). Every claimant keeps the right to have their own claim heard and decided individually, and no claimant is bound by the outcome of another claimant's arbitration. Any limitation period for a demand is paused while that demand waits to be administered under this procedure.

19.10 Right to Opt Out. You may reject this agreement to arbitrate by emailing [email protected] with the subject "Arbitration Opt-Out" within 30 days after you first accept terms that contain it. Send it from the email address on your account and include your full name and a clear statement that you reject arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Wyoming (Sheridan County, or the U.S. District Court for the District of Wyoming), and everything else in the Terms of Service and any agreement you signed with us still applies.

19.11 Changes to This Section. If we change this agreement to arbitrate after you accept it, the change will not apply to any dispute that either of us gave notice of before the change took effect. You may reject a material change to this agreement to arbitrate by emailing us as described under Right to Opt Out within 30 days after we notify you of the change, and the version you previously accepted will continue to apply to you.

19.12 One Clause; Precedence. This same agreement to arbitrate appears in our Terms of Service, Funded Trader Agreement and Affiliate Agreement. If any other terms we provide (such as promotion or giveaway rules) contain a different dispute-resolution, forum or venue provision, this agreement to arbitrate controls unless those other terms expressly say they replace it.

19.13 Survival and Severability. This agreement to arbitrate survives the end of your account and of any agreement between us. Except as stated in the Class Action Waiver, if any part of it is found unenforceable, that part is severed and the rest remains in effect.

20. Governing law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules, and the agreement to arbitrate in Section 19 is governed by the Federal Arbitration Act. Subject to Section 19, any court proceeding will be brought only in the state or federal courts located in Wyoming (Sheridan County, or the U.S. District Court for the District of Wyoming), and you and we consent to their jurisdiction.

Nothing in these Terms removes rights you have under mandatory consumer protection laws of the country where you live that cannot be waived by contract.

21. Changes to these Terms

We may update these Terms. For a material change we will tell you by email or in the dashboard, generally at least 14 days before it takes effect, and we will ask you to accept the updated Terms by ticking a box before you continue to use your account or make a new purchase. A change does not alter the rules recorded for an account you already bought (Section 4), and changes to Section 19 are limited as described there. Earlier versions remain available on request.

22. General

"Sister Companies" means entities under common control with Funded With Forex LLC, including Vera Charts LLC, FundedWithFutures LLC and CryptoPropX LLC. They are intended third-party beneficiaries of Sections 16 to 19 and may enforce them directly.

These Terms, the policies and agreements named in Section 1, and any rules shown at purchase are the entire agreement between you and us about the Services and replace any prior statements, whether written, oral or automated. If any provision is unenforceable, it is enforced to the extent permitted and the rest remains in effect (except as stated in Section 19). Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to a successor or affiliate. We are not liable for delays or failures caused by events beyond our reasonable control. Section headings are for convenience only.
